City A.M. Terms & conditions for external contributors

This agreement sets out the terms and conditions under which City A.M. accepts material from external contributions for City A.M., City A.M. Bespoke, CityAM.com, its email newsletters and any other physical or electronic publications owned by City A.M. Limited (the company). These terms and conditions hold unless explicitly varied in a signed contract between the company and the contributor.

Externally contributed material includes any copyright work as set out in the copyright legislation and includes both material intended for publication and background materials used directly or indirectly to prepare material for publication. It includes written and pictorial formats, including but not limited to columns, articles, infographics, videos, illustrations and photographs, as well as user-generated content such as letters or emails to the editor and comments on the website.

By submitting material for publication or accepting a commission to prepare material for publication or by using websites owned by the company you agree to be legally bound by these terms which will take effect immediately. If you do not agree to be legally bound by these terms, please do not contribute to the website or offer your material for publication.

Rights in the material

These Rules set out how you can enter for a chance to win a gift card  worth £500 by participating in a prize draw available to all qualifying City AM readers who complete the 5 minute survey (“Competition”). The Promoter is City A.M. Limited (trading as City AM) whose registered office is at Icon 1 7-9 Sunbank Lane, Ringway, Altrincham, United Kingdom, WA15 0AF (“City AM” or “we”). 

By entering the Competition, you are deemed to have read and understood these Rules and shall be unconditionally bound by them. A copy of these Rules shall be available at https://www.cityam.com/terms-conditions/  for the duration of the Competition. These Rules should also be read in conjunction with Harrod’s terms and conditions, available at https://www.harrods.com/en-gb/legal/terms-and-conditions?icid=footer_bottom_terms-and-conditions.

How to enter

To be entered into this Competition, you will need to:

  1. complete the survey at https://www.cityam.com/reader-survey/; and 
  2. enter your first name, last name, and email address between 5:00 on 22 January 2024 and 16:59 on 12 February 2024 (“Qualifying Entry”). 

Opening and closing dates

The Competition will begin at 5:00 GMT on 22 January 2024 (“Opening Date”) and will close at 16:59 GMT on 12 February 2024 (“Closing Date”). Any entries submitted after the Closing Date will not be counted. No responsibility will be taken by City AM for any entry that is misdirected, lost for technical or other reasons or received after the Closing Date.

Who can enter and entry restrictions

Only one entry per person. 

You must be at least aged 18 years of age (or the age of majority in the jurisdiction where you reside if higher) at the time of entry. The Competition is only open to residents City AM. City AM reserves the right to request proof of age and residency before awarding any prize and to disqualify any entrant who is unable to provide such proof on request. 

You are not permitted to enter the Competition if you are an employee of City AM or any THG company, their direct family member or agent, or if you are otherwise professionally connected with the Competition.

In entering the Competition, you confirm that you are eligible to do so and eligible to claim any prize you may win. 

Prizes

An eligible entrant may receive one of the following prizes:

  1. £500 Harrods Gift Card: One winner will receive a £500 Harrods Gift Card (“Prize”). The winner will be selected at random from all eligible entries within 72 hours of the Closing Date in a draw supervised by an independent observer. The winner will be notified by email within 5 days of the Closing Date (“Prize Notification”). The winner must respond by email to the Prize Notification to confirm that the winner accepts the Prize and must provide the details requested in the Prize Notification to the Promoter. Failure by the winner to respond to the Prize Notification and provide the details requested in the Prize Notification to the Promoter within 7 days of the Promoter sending the Prize Notification will be deemed to be a forfeiture of the Prize by the winner and the Promoter reserves the right to select another winner (again selected randomly in a draw) from all remaining Qualifying Entries. 

Prize to be fulfilled by: Harrods Limited whose registered office is at 87/135 Brompton Road, London, SW1X 7XL (“Prize Provider”).

Each Prize is as stated and no cash or other alternatives to the Prizes will be offered. The Prizes are not transferable. 

A Prize may not be claimed by a third party on a winner’s behalf. City AM does not accept any responsibility if a winner is not able to take up a Prize.

Only 1 prize per entrant and per household. 

Except to the extent that City AM is prevented by law from doing so, City AM will publish the surname and town/county of residence of the Prize winners on City AM website and social media pages. If you object to your surname and/or county being published or made available, please contact City AM  adops@cityam.com or 020 3201 8962. In such circumstances, City AM may still provide this information to a relevant regulator on request.

Disqualification 

To claim a Prize, an entrant must have complied with and remain in compliance with these Rules. If an entrant does not comply with all of the above requirements within the above time frames, or does not otherwise comply with these Rules, we may disqualify the entrant without any liability to that entrant. 

We reserve the absolute right to disqualify without notice any entrants who we consider to have used improper technical means to enter the Competition and/or we believe have engaged in fraudulent or abusive activities in connection with the Competition.

Limitation of Liability 

City AM will not be liable for or accept any responsibility for: (i) any failure by the winner(s) or any entrant to comply with these Rules; (ii) any disruption, delay or misdirection of entries; or (iii) any server, system or network failures, malfunctioning or inaccessibility. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Competition, if it is possible. 

Notwithstanding this section (Limitation of Liability), nothing in these Rules shall be construed to limit or exclude City AM liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability whose limitation is prohibited by law.

Data Protection 

City AM collects and uses personal data to conduct the Competition, as is necessary for City AM to be able to perform its agreement with you and in order to comply with its legal obligations, including to select the winners, deliver the prizes and publish the results (as required by advertising regulations).

Governing law and jurisdiction

The Competition, these Rules and any dispute arising therefrom shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales. 

The above choice of law and jurisdiction does not deprive entrants of the protection under mandatory statutory provisions that cannot be waived under the law which would have otherwise been applicable. 

General 

All of our decisions will be final and binding and no correspondence will be entered into. 

If any provision of these Rules (or any part thereof) is held to be invalid or otherwise unenforceable or illegal, the invalidity or unenforceability of any provisions (or any part thereof) shall not affect the validity or enforceability of any other provision and all remaining provisions (or any part thereof) will remain in full force and effect and shall be construed in accordance with their terms as if the invalid or unenforceable or illegal provision were not contained herein.

The original version of these Rules is drafted in the English language. If these Rules are translated into any other language, the English language version shall prevail.
