The High Court has rejected a challenge by UK Uncut, upholding the tax arrangements of investment bank Goldman Sachs as lawful. From the full ruling, Justice Nicol:
The settlement with Goldman Sachs was not a glorious episode in the history of the Revenue.
However, my task is to decide whether the decisions of HMRC under challenge were unlawful. As Simon J. said when granting permission to apply for judicial review, “maladministration and illegality are separate issues.”
